Waivers & Legal Terms

"Event" means the Adidas Top 50 Showcase (U11–U14) and all related tryouts, practices, games, warm-ups, photo/video sessions, ceremonies, and travel to and from the venues.

"Organizers" means Toronto Ontario Prospect (TOP), Diamond Basketball Inc., and their respective directors, officers, employees, coaches, volunteers, referees, medical staff, contractors, agents, insurers, and successors.

"Released Parties" means the Organizers together with the venues and facility owners/operators, invited clubs, sponsors and partners (including adidas and CrediVersity), and each of their affiliates, employees, and agents.

"Participant" means the registered player. "Guardian" means the parent or legal guardian who registers the Participant and who has full legal authority to bind the Participant to these terms.

Basketball is a physical contact sport carried out on hard surfaces at speed. Participation involves inherent and unavoidable risks that cannot be eliminated regardless of the care taken. These risks include, without limitation: sprains, strains, fractures, dislocations, dental and facial injuries, concussion and other head, neck or spinal injuries, heat illness and dehydration, cardiac events, permanent disability, paralysis, and death.

Risks also include contact or collision with other participants, officials, equipment, walls, floors, standards or bleachers; slips and falls; defective or unsuitable equipment; conditions of the facility; the negligence of other participants or spectators; exposure to communicable illness; and the possibility that medical assistance, first aid, or emergency response may be delayed, unavailable, or inadequate.

The Guardian confirms that the Participant is physically fit and medically cleared for strenuous athletic activity, that participation is entirely voluntary, and that the Guardian has read, understood, and freely and expressly accepts and assumes all such risks on behalf of themselves and the Participant.

In consideration of being permitted to participate in the Event, the Guardian, on their own behalf and on behalf of the Participant and their heirs, executors, administrators, and assigns, agrees: (a) to WAIVE ANY AND ALL CLAIMS they have or may in future have against the Released Parties; and (b) to RELEASE AND FOREVER DISCHARGE the Released Parties from any and all liability for any loss, damage, injury, illness, expense, or death however caused, arising out of or in any way connected with participation in the Event, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE OF THE RELEASED PARTIES, and including any claim relating to the condition of the premises or equipment or the conduct of other participants or spectators.

This release does not apply to liability that cannot lawfully be waived, including gross negligence or wilful misconduct where applicable law prohibits its exclusion, and does not limit any right to statutory accident or health benefits.

The Guardian agrees to HOLD HARMLESS AND INDEMNIFY the Released Parties from any claim, demand, action, cost, or expense (including reasonable legal fees) brought by or on behalf of the Participant, or arising from the Participant's or Guardian's acts, omissions, damage to property, or breach of these terms.

Lost, stolen, or damaged personal property is not the responsibility of the Released Parties. Personal belongings are brought to the venue at the owner's sole risk.

The Guardian authorizes Event staff, first-aid responders, athletic therapists, and emergency medical personnel to provide first aid and to arrange emergency medical treatment, transportation, or hospitalization for the Participant if the Guardian cannot be reached. The Guardian accepts financial responsibility for all such medical, ambulance, and treatment costs not covered by provincial health insurance or private insurance.

The Guardian confirms that all medical conditions, allergies, medications, and prior injuries relevant to participation have been disclosed truthfully in the registration form, and undertakes to update the Organizers of any change before the Event.

Any Participant suspected of sustaining a concussion or head injury will be removed from play immediately and may not return without written clearance from a qualified medical practitioner. Removal decisions are final and are not grounds for a refund.

The Released Parties do not provide accident, medical, dental, or disability insurance for Participants. Families are strongly encouraged to maintain their own coverage.

The Guardian grants the Organizers and their designated media partners an irrevocable, royalty-free, worldwide licence to photograph, film, record, stream, and reproduce the Participant's image, likeness, voice, first name, division, and performance statistics captured at the Event.

This material may be used in any medium for Event promotion, the public roster and player profiles, highlight archives, recaps, social media, sponsor and partner communications, and historical records, without further notice, approval, compensation, or inspection rights.

The Organizers do not publish home addresses, dates of birth, medical information, or guardian contact details on public pages. A Guardian who does not consent to media use must notify the Organizers in writing before the Event; the Organizers will make reasonable efforts to exclude the Participant from newly produced material but cannot control third-party spectator recordings, broadcast crowd footage, or material already published.

Participants, guardians, and spectators must treat officials, staff, volunteers, opponents, and venue personnel with respect at all times, follow all venue rules and staff directions, and refrain from abuse, harassment, discrimination, threats, violence, vandalism, alcohol or drug use, and any illegal activity.

The Organizers may, at their sole discretion and without refund, remove or exclude any person from the Event, revoke an invitation, or suspend or disqualify a Participant for breach of this Code, falsified registration information, age or eligibility misrepresentation, or conduct that endangers others.

Children remain the responsibility of their guardians outside of scheduled on-court activity. The Event does not provide childcare or supervision of non-participating siblings.

Registration is invitation-only. Divisions are determined solely by birth year (2016 = U11, 2015 = U12, 2014 = U13, 2013 = U14). Falsified age or identity documentation voids the registration without refund.

Team assignments, playing time, game format, schedules, court allocation, and roster placement are determined by the Organizers at their sole discretion and are final. No specific amount of playing time, exposure, scouting attention, evaluation outcome, or future opportunity is promised or guaranteed.

Jersey numbers are allocated by Event staff at uniform hand-out. Numbers are not reserved, requested, or auto-assigned at registration, and may change to accommodate uniform inventory.

The Organizers may change venues, dates, formats, divisions, or officials, and may postpone, shorten, or cancel all or part of the Event due to weather, facility closure, public health orders, labour disruption, insufficient registration, or other causes beyond their reasonable control (force majeure).

Registration fees are stated in Canadian dollars and are processed by our third-party payment provider. The Organizers do not receive or store full card numbers. Provider terms and fees also apply to your transaction.

Registration fees are non-refundable and non-transferable once a roster spot is confirmed, except where required by law. If the Event is cancelled in full by the Organizers and not rescheduled, paid registrants will receive a credit or refund of the registration fee, less non-recoverable costs already incurred (such as uniforms already produced).

Refunds are not issued for injury, illness, travel disruption, missed games, schedule changes, removal for breach of the Code of Conduct, or voluntary withdrawal.

Discount and complimentary-entry codes are issued at the Organizers' discretion, have no cash value, and may be revoked if used in error or without authorization.

Registration data is collected to operate the Event: eligibility and division checks, rosters, uniform ordering, check-in, medical safety, and Event communications. It is stored on secured infrastructure with access restricted to authorized Event staff.

Personal information is not sold. Limited information is shared with service providers (payment processing, email delivery, hosting) strictly to deliver these functions, and with medical or emergency personnel where necessary to protect health and safety.

Only a Participant's first and last name, division, club, position, photo, and public profile details appear on public roster pages. Guardians may request correction or deletion of a Participant's data by contacting the Organizers; deletion after the Event may end roster visibility.

Event emails are transactional. Marketing-style messages, where sent, include an unsubscribe link.

Sponsors and partners, including adidas and CrediVersity, support the Event but do not organize, supervise, coach, officiate, or control any Event activity and assume no responsibility or liability for it.

Third-party websites, products, offers, and educational resources linked or referenced by the Event are provided as-is by their owners. The Organizers make no representation or warranty about them and are not liable for them.

The Event, this website, and all related information are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the maximum extent permitted by law, the total aggregate liability of the Released Parties for any claim arising out of the Event or these terms is limited to the registration fee actually paid for the Participant, and the Released Parties are not liable for indirect, incidental, special, consequential, punitive, or economic loss, including loss of opportunity or reputation.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario have exclusive jurisdiction over any dispute.

If any provision is found unenforceable, it will be severed or read down to the minimum extent necessary and the remaining provisions remain in full force. These terms constitute the entire agreement regarding participation and supersede any prior representation.

The Guardian confirms they are 18 years of age or older, have the legal authority to sign for the Participant, have had the opportunity to seek independent legal advice, are signing freely and voluntarily, and understand that a typed name submitted through the registration form is a binding electronic signature.
